Guadalupe Garcia, 57, died in custody at the South County Detention Center in Tulare County on July 25, 2022, after an arrest for driving under the influence.

What is on the record

ReportedGarcia's family filed a wrongful-death lawsuit against Tulare County, the sheriff's office and deputies in 2023 and amended it in 2024 after obtaining video. The family's attorneys allege that deputies restrained Garcia face-down for several minutes and that he did not receive aid for about an hour. The sheriff's office has said the medical examiner listed the death as an accidental methamphetamine overdose, and has declined further comment because of the litigation (ABC30).

The question this entry follows

AnalysisThe dispute is, at its center, a question of death certification: who determines the manner of death when someone dies in custody, on what evidence, and whether that office is independent of the agency whose conduct is at issue. KPS Gill, MD will follow the case through the court docket and county records, and will report both the family's allegations and the existing classification without choosing between them before a court or a re-examination does.
