Legal effect
Organizations that start or respond to No Surprises Act payment disputes can create IDR Gateway accounts. Patients’ surprise-billing protections are unchanged; the Gateway is provider–payer dispute machinery.
What this establishes
- CMS states that all potential users of the IDR Gateway can begin creating accounts on 15 September 2026, and that the Federal IDR process will transition from single-use web forms to the Gateway in late 2026.
- Organizations should designate at least one Gateway administrator (CMS recommends two, and no more than ten). The Gateway adds identity verification and permits only U.S.-based users.
- The Federal Independent Dispute Resolution Operations final rule was published 4 June 2026 and is effective 3 August 2026.
What this does not establish
- Any new obligation on patients, who do not use the IDR process.
- That web forms have already been retired.
Why it matters
The dispute process has received millions of submissions since 2022. Its infrastructure now changes; the patient-facing protection does not.
