California’s minimum wage goes to $17.40 on 1 January 2027 — and it moves four other numbers with it

The Director of Finance certified the 2027 rate on 31 July 2026. The hourly figure is the least consequential part of it: the overtime-exemption salary floor, the industry-specific schedules and the posting duty all move at the same time, and only one of them is indexed to your city.

The hourly figure is the smallest thing that changes

A minimum wage certification is usually reported as one number. In California it is closer to a switch that moves five separate obligations at once, because several other thresholds in state law are defined as multiples of the state rate rather than as figures of their own.

The exemption threshold is where the money actually is. An employee paid a salary below $72,384 from 1 January 2027 is not exempt from overtime on the salary test, whatever their job title says — and the threshold is twice the state minimum for full-time work and cannot be pro-rated, so a half-time salaried employee must still be paid the full annual figure to be treated as exempt. Salary alone never establishes an exemption; the duties test applies independently.

Local ordinances, and the one thing they do not touch

At least three dozen California cities set a minimum wage above the state figure. They are concentrated in the Bay Area and Southern California; where one applies, the employer pays the higher of the two. Whether your city is on that list is a question with a published answer and is worth checking rather than assuming, because Valley readers frequently work for employers headquartered under a different local ordinance than the one where the work is performed — and the rate follows the place of work.

The exception is precise and often missed: only the state minimum wage determines the exempt salary threshold. A city ordinance at $19 an hour does not raise the salary floor for exempt status in that city. The two figures come from different instruments and do not interact.

Who this does not reach

Three groups sit outside the ordinary rule and are worth naming, because a wage page that implies universal coverage misleads exactly the people most likely to be underpaid. Learners in their first 160 hours in an occupation may be paid a reduced rate under the wage orders. Certain employees with a disability may be covered by a special licence provision. And an independent contractor is not covered by a minimum wage at all — which makes the classification question, not the rate, the operative one for a large share of Valley agricultural, delivery and construction work.

California has no tip credit. A tipped employee is owed the full minimum wage in cash before tips, and tips are not counted toward it.

What to do if the rate is not paid

The remedy is administrative before it is judicial. A worker paid less than the applicable minimum files a wage claim with the Labor Commissioner’s Office — the Division of Labor Standards Enforcement — which holds a settlement conference and, failing settlement, a hearing before a hearing officer. There is no filing fee, immigration status is not a bar to recovery, and retaliation for filing is separately unlawful and separately actionable.

What helps a claim: dated records of hours worked kept independently of the employer, pay stubs, and the itemised wage statement the employer is required to provide. What weakens one: reconstructing hours from memory months later. If the rate is wrong now, the record to start keeping is today’s.
