What changed

The window for feedback on Considerations for the Regulation of Generative AI-Enabled Medical Devices closed. The paper floats:

  • a two-axis risk framework;
  • a "competency-based" premarket approach (benchmarking plus clinical confirmation);
  • risk-proportionate postmarket monitoring;
  • treatment of foundation models and agentic AI.

What this establishes

FDA has collected public input on a possible approach.

What this does not establish

It is not guidance, draft or final, and not a rule. Nothing in it binds a manufacturer.

Next decision point

CDRH's FY2027 guidance agenda (posted Oct 1) lists a generative-AI risk and evidence document as "under construction". It also lists a draft on generative-AI conversational devices for mental disorders on the A-list.
